Tony Zirkle will explain your rights and responsibilities with respect to the issues and disputes that often arise in a Indiana divorce: division of the marital property and debts, custody and support of children, and alimony or spousal maintenance. Indiana is an equitable distribution state when determining property division issues; therefore, you should presume that the court will seek to make an even division of the property, but the court has wide discretion to give one spouse or the other a larger share of the property. Nevertheless, in some cases, property division is negotiated and discussed along with alimony in an attempt to maximize the value of each party's share of a complex marital estate. The court takes tax attributes and retirement benefits into account while negotiating.
With the help of a lawyer, most disputed issues in divorce are settled by an agreement between the former spouses. What is more, from the commencement of the case, our family law team works toward obtaining the short-term arrangements for custody of the children, visitation and parenting time for the spouse moving out of the marital home, payment of bills, support for the children, and other matters that must be settled within the first twenty-one (21) days after the divorce case is filed with the court of law. However, if the spouses refuse to agree to these interim terms, the family law judge will likely order temporary custody and support arrangements that fulfill neither party.
After the temporary arrangements have been accepted or ordered by the court, we work on recognizing the issues that will likely be contested, whether they concern the separation of marital property, the amount of child support payments, or the implementation of a parenting time schedule. In some Indiana counties, there is mandatory mediation between the parties before the court will hear a motion to resolve a dispute in favor of one spouse or the other. Yet, in other counties, mediation is not required before the judges will listen to and resolve disputed issues.
